US DEVELOPMENTS – August 2022

Please find attached, at  Annex A,  the monthly report of  the Chamber of Shipping of America (CSA) for August 2022. 

The report (inter alia):

      1. Updates on the status of the Clean Shipping Act (HR 8336), which reportedly has no hearings scheduled and is therefore unlikely to be enacted this session; 

     2. Outlines implementation issues related to the recently passed Ocean Shipping Reform Act (OSRA), noting that a number of actions related to shippers’ access to services are now being identified under the premise of the act:

     3. Advises that the FMC is considering using its emergency powers established under the OSRA to enable data sharing across the logistics chain in order to alleviate port congestion; 

     4. Provides information on an interim report produced by the California Air Resources Board (CARB) concerning the 2020 California Ocean-Going Vessel at Berth Regulation (which requires compliance deadlines from Jan 1 2023 for some vessels); and a recently published report by DNV which outlines significant concerns with the regulatory timeline of this legislation; and 

     5. Reminds that comments remain open on the proposed North Atlantic Right Whale Vessel Strike Reduction Rule, and that members are invited to submit these to CSA by 20 September.
