CALIFORNIA AIR RESOURCES BOARD (CARB) – AMENDED OCEAN-GOING VESSELS AT BERTH REGULATIONS – ENTER INTO FORCE 1ST JANUARY 2023

Please be advised that, in August 2020, the California Air Resources Board (CARB) amended the Ocean-Going Vessels At-Berth Regulation to increase emissions reductions from vessels visiting California’s ports and marine terminal complexes (MTC). The amended regulation expands requirements of the original at-berth regulation to include auto carriers (ro-ro) and tanker vessels, and new ports and terminals and enters force on 1/1/2023.
Additionally, the amended regulation shares responsibilities for compliance between vessels, terminals, and ports. With the 2020 Regulation, every container, reefer, cruise, ro-ro, auto carrier, and tanker vessel, and every regulated terminal operator will have an obligation to cooperate as necessary to meet the 2020 Regulation’s emissions reduction requirements on every single visit to any regulated terminal. Although Bulk and General Cargo vessels are exempt from the emission reductions requirements, these vessel types are still subject to the reporting requirements of the regulation. Ports also have expanded responsibilities under the 2020 Regulation, including ensuring that any terminal customer operating at their port has the infrastructure needed to comply with the 2020 Regulation.
