Prohibition of Unauthorized Use of Low Earth Orbit (LEO) Satellite Communication Devices in Chinese Waters

We wish to inform all HKSOA members regarding the legal restrictions on the use of unauthorized Low Earth Orbit (LEO) satellite communication devices, such as Starlink terminals, within Chinese territorial waters.

According to Article 24 of the Maritime Traffic Safety Law of the People’s Republic of China, vessels operating within Chinese jurisdiction are required to use domestic coastal radio stations or satellite gateways for communication. Specifically, the law mandates that communication on vessels be transferred via shore-based radio stations within Chinese waters through domestic coastal radio stations or satellite gateways established in accordance with the law.

Chinese maritime authorities have recently intensified enforcement against unauthorized satellite communication equipment. The use of unauthorized satellite communication devices, including LEO terminals, within Chinese territorial waters is illegal and subject to penalties. Vessels equipped with such devices are required to cease their use upon entering Chinese waters to comply with Chinese maritime laws.

To ensure compliance with Chinese maritime regulations and avoid potential penalties, HKSOA members are advised to:

– Discontinue Use: Cease the use of any unauthorized LEO satellite communication devices, such as Starlink terminals, upon entering Chinese territorial waters, and change to use permissible devices, such as Inmarsat etc.
– Consult Authorities: For guidance on permissible communication equipment and practices within Chinese waters, consult the relevant maritime authorities or legal advisors.
– Stay Informed: Regularly review updates from the HKSOA and Chinese maritime authorities regarding communication regulations to ensure ongoing compliance.

Adhering to the Maritime Traffic Safety Law of the People’s Republic of China is essential for the safe and lawful operation of vessels within Chinese waters. We urge all members to take immediate action to comply with these regulations and avoid any legal complications.
