SkillsPlus believes in Benjamin Franklin’s saying “An ounce of prevention is worth a pound of cure.” Negotiating, drafting and, most importantly, executing a Shipping Contract is an extremely important area of shipping where “knowledge and understanding of past disputes and resulting case law; attention to detail and the “look before you leap attitude” can go a long way to save money, time and relationships. 


 


Course dates: 12th, 13th and 14th July (three sessions of 2.5/2.5/2 hours respectively)

Risk



  • Identification of risks, risk management and steps required for risk management; Static & Dynamic

  • Risk transfer, retention and mitigation

  • Segment specific risks


 


Contract Law



  • Basics of a contract & the development of case law

  • Our Word Our Bond & coming into existence of shipping contracts

  • Sale of Goods Act 1979 and implied terms into sale contracts (Res Cogitans case) 

  • Importance of tried and tested clauses, and  avoid homemade clauses.


 


Discussion (includes real cases) of important clauses in:



  • Charterparties (Arrived Ship, Commencement of Laycan, Safe Port etc.)

  • Bills of Lading  & LOIs (Misdelivery Claims, Clean Vs Dirty Bills, Fraud)  

  • Sale & Purchase Contracts (Condition on Delivery, Application Sale of Goods Act, Union Power)

  • Shipman (Liability, Insurance and Obligations)

  • A routine Supplier Contract (Payment terms & SGA 1979, Buyer Beware)


 


Negotiations and identification of whether there is a contract


Difference between English Law and American Law


 


Course Fee:


Special online course fee for three intensive sessions (total 7 learning hours): US$450 per person.


Maritime and Law University students (unemployed): 80% discount (fixed fee US$90 per person)


Maritime and Law University Faculty: 50% discount (fixed fee US$225 per person)


Members of ICS, NI, CMMI, WISTA: 10% discount
